Texas Amendments May Require Registration for SMS Marketers

Recent Amendments to Texas’s telemarketing laws have the potential to significantly impact retailers who operate SMS marketing programs. Unless an exemption applies, text message marketers may be required to register with the Texas Secretary of State and post a bond. While many traditional catalog marketers will remain exempt from the registration requirement, e-commerce retailers should evaluate their businesses and their use of SMS marketing to determine whether they have an obligation to register as a telemarketer in Texas.
